Federal Judge Mandates Release of Abrego Garcia from ICE Detention
A court has ordered the prompt discharge of Kilmar Abrego Garcia from detention by ICE, concluding his continued detainment lacks lawful basis.
"Since Abrego Garcia's release after erroneous detention in El Salvador, he has been taken back into custody, again without legal justification," the judge stated in her order.
The case stems from a mistaken deportation to El Salvador in March, which US authorities later admitted was an error. After his return to the United States to answer human smuggling charges, he was detained in federal detention.
In her order, the judge pointed out that the government lacks a valid deportation order, which effectively blocks them from deporting Mr. Abrego Garcia "at this juncture."
